These Terms of Service and Fair Use Policy ("Terms") govern your use of the Telagent service and the telagent.com.au website ("Site"). "Telagent", "we", "us" and "our" refer to the operator of telagent.com.au. By signing up for a free trial or a paid plan, or otherwise using our service, you agree to these Terms.
1. What Telagent provides
Telagent is an automated phone-reception service for trade and small businesses. Our assistant answers your business calls, captures caller details, can book jobs into your calendar, and sends SMS notifications and confirmations. Telagent is a reception assistant that supports your business — it does not replace your own judgement, record-keeping or professional obligations.
2. Plans and pricing
We offer several plans (currently ANSWER, BOOK and COMMAND). The features and current prices for each plan are shown on our website. All prices are in Australian dollars (AUD). We may change our plans or prices from time to time; any change to your plan price will be notified in advance and will not affect your current billing period.
3. Free trial and billing
- The ANSWER and BOOK plans include a 14-day free trial. We capture your payment details at signup but do not charge you until the end of the trial. You may cancel at any time during the trial and you will not be charged.
- The COMMAND plan is not available on a self-serve trial; it includes a 30-day money-back guarantee on the first month.
- Paid plans are billed monthly in advance. A minimum term of two months applies after your first paid month.
- You can cancel at any time during a trial, or after the minimum term, by contacting us.
4. Fair Use Policy
Some plans describe calls as "unlimited". "Unlimited" is subject to fair use, so we can keep prices low and service quality high for all customers:
- BOOK plan: fair use is approximately 350 answered calls per calendar month. This comfortably covers any single-vehicle trade business.
- ANSWER plan: includes up to 150 answered calls per calendar month.
- If your usage consistently exceeds the fair-use level for your plan, we will contact you to move you to a plan that better suits your call volume (such as COMMAND, which is designed for multi-vehicle and high-volume operations).
- We may manage, throttle or suspend call handling where traffic is abnormal, automated or abusive — for example spam, robocalls, or use that is not consistent with a genuine trade-reception service, or any unlawful use.
5. Automated assistant and call recording
Calls answered by Telagent are handled by an automated (AI) assistant, not a live person, and may be recorded for quality, accuracy and record-keeping. Callers are told this at the start of each call. You are responsible for ensuring your use of Telagent is consistent with your own obligations to your customers, including any notice or consent requirements that apply to your business.
6. Your responsibilities
- Provide accurate business information (services, hours, service areas, calendar access) and keep it up to date.
- Use the service lawfully and only for your own genuine business reception.
- Maintain your own records and follow up with your customers — Telagent captures and passes on information but does not guarantee any particular business outcome.
- Keep your account credentials secure.
7. Service availability
Telagent relies on third-party services including telephony carriers, calendar providers and internet infrastructure. While we aim for high availability, we do not guarantee that the service will be uninterrupted, timely, secure or error-free, and we are not responsible for outages or failures of third-party services outside our control.
8. Limitation of liability
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or other law that cannot lawfully be excluded. Subject to those rights, and to the maximum extent permitted by law:
- our total liability arising out of or in connection with the service is limited to the fees you paid to us in the three months before the event giving rise to the claim; and
- we are not liable for any indirect or consequential loss, or for missed calls, missed or incorrect bookings, or lost business, arising from service interruptions, third-party outages, or caller behaviour.
9. Privacy
We handle personal information in accordance with the Australian Privacy Principles and our Privacy Policy. Please read it to understand how we collect, use and store information, including call recordings and caller details.
10. Intellectual property
All intellectual property in the Telagent service, Site and materials remains ours or our licensors’. You may not copy, resell or reverse-engineer the service.
11. Changes to these Terms
We may update these Terms from time to time. The "last updated" date above shows when they were last changed. Material changes will be notified to active customers. Continuing to use the service after a change means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
